General Terms and Conditions for Forró Group Dance Classes

1. Applicability

1.1 These general terms and conditions (the "Terms and Conditions") apply to all agreements between Forró Den Haag, and any student (hereinafter referred to as "the Student") who registers for and participates in group forró dance classes provided by Forró Den Haag. For the purpose of these Terms and Conditions, Forró Den Haag shall be considered the provider of the classes.

1.2 By registering for classes, the Student agrees to the applicability of these Terms and Conditions.

1.3 Any deviations from these Terms and Conditions must be agreed upon in writing between Forró Den Haag and the Student.

2. Payment Terms

2.1 The fees for forró group dance classes are as set out in the class schedule and registration form. All fees include VAT.

2.2 Payment is due in full prior to the start of the course, unless otherwise agreed in writing.

2.3 To secure your spot in the classes, please make your payment in full through our website: forrodenhaag.nl/classes.

2.4 If the Student fails to make payment as required, Forró Den Haag reserves the right to deny the Student participation in the classes.

3. Cancellation and Rescheduling

3.1 Cancellation by the Student:

3.1.1. Forró Den Haag's cancellation policy is as follows:

• Cancellation more than 14 days before the start of the course: Full refund, minus an administrative fee of €10.
• Cancellation between 7 and 13 days before the start of the course: 50% refund.
• Cancellation 7 days or less before the start of the course: No refund will be given.
• Cancellation after the course has started: No refund will be given for the remaining classes.
• Long-term illness: In the case of illness lasting longer than three (3) weeks, the Student may be eligible for a pro-rata refund for the remaining classes.

3.1.2. Any cancellations by the Student must be communicated to Forró Den Haag in writing to contac@forrodenhaag.nl

3.2 Cancellation and Rescheduling by Forró Den Haag:

3.2.1 Forró Den Haag reserves the right to cancel or reschedule classes due to unforeseen circumstances, such as instructor illness or venue unavailability.
3.2.2 In such cases, Forró Den Haag will offer the Student alternative class dates or a refund for the cancelled classes.

4. Missed Classes

4.1 There will be no refunds or make-up classes for classes missed by the Student.

4.2 The Student is responsible for keeping up with the class curriculum in case of absence.

4.3 Students are encouraged to connect with fellow students (e.g., through a WhatsApp group) to stay informed about missed content.

4.4 Forró Den Haag instructors may provide supplementary materials or guidance to help the Student catch up, at Forró Den Haag's discretion.

5. Class Level Progression

5.1 The Instructor(s) will assess the Student's progress throughout each trimester and determine when the Student is ready to advance to the next level, in accordance with the level progression guidelines outlined on forrodenhaag.nl/classes/levels.

5.2 The Instructor's decision regarding advancement is final.

5.3 Forró Den Haag may offer revision classes to help students prepare for advancement, at their discretion.

6. Liability

6.1 The Student acknowledges that participation in dance classes involves physical activity and carries inherent risks. The Student participates in the classes at their own risk.

6.2 To the maximum extent permitted by Dutch law, Forró Den Haag shall not be liable for any injury, damage, or loss sustained by the Student during or as a result of participating in the classes, unless caused by Forró Den Haag's instructors gross negligence (grove schuld) or willful misconduct (opzet).

6.3 Forró Den Haag is not responsible for any loss or damage to the Student's personal belongings.

7. Code of Conduct

7.1 The Student is expected to behave respectfully towards Forró Den Haag and other students.

7.2 The Student shall adhere to any rules of conduct communicated by Forró Den Haag, available at forrodenhaag.nl/code-of-conduct, including those related to appropriate attire and hygiene.

7.3 Forró Den Haag reserves the right to refuse service to a Student who violates the code of conduct or disrupts the learning environment.

8. Intellectual Property and Use of Images

8.1 All intellectual property rights, including copyrights, related to class materials, choreography, and any other content provided by the instructor, remain the exclusive property of the instructor.

8.2 The Student is prohibited from reproducing, sharing, or distributing class materials or choreography to others, or using them for any commercial purpose, without the prior written consent of the instructor. This includes, but is not limited to, selling the materials or using them to teach others for profit.

8.3 During classes, photos and videos may be taken for marketing and promotional purposes. If any student does not wish to be included in such photos or videos, they should inform the instructor during the course.

9. Health and Safety

9.1 The Student is responsible for ensuring that they are physically fit to participate in the dance classes.

9.2 The Student shall inform the instructor of any existing injuries, medical conditions, or physical limitations that may affect their ability to participate in the classes.

9.3 Forró Den Haag reserves the right to refuse service to a Student if Forró Den Haag believes that the Student's participation may pose a risk to their health or safety.

10. Changes to Services

10.1 Forró Den Haag reserves the right to make reasonable changes to the class schedule, instructors, or location.

10.2 Forró Den Haag will notify the Student of any significant changes as soon as reasonably possible.

11. Privacy Policy

11.1 Forró Den Haag will collect, use, and protect the Student's personal data in accordance with the General Data Protection Regulation (GDPR) and Forró Den Haag's privacy policy, which is available at [Link to your privacy policy].

12. Complaints Procedure

12.1 Any complaints regarding the services provided by Forró Den Haag should be submitted in writing to contact@forrodenhaag.nl as soon as possible.

12.2 Forró Den Haag will respond to any complaints within a reasonable timeframe and attempt to find a satisfactory resolution.

13. Amendments to Terms and Conditions

13.1 Forró Den Haag reserves the right to amend these Terms and Conditions when necessary.

13.2 Forró Den Haag will notify the Student of any significant changes to the Terms and Conditions in writing or by posting the updated Terms and Conditions on Forró Den Haag's website at forrodenhaag.nl/classes/terms-and-conditions.

13.3 The Student's continued participation in classes following the notification of changes constitutes acceptance of the amended Terms and Conditions.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions and any agreements between Forró Den Haag and the Student shall be governed by and construed in accordance with the laws of the Netherlands.

14.2 Any disputes arising out of or in connection with these Terms and Conditions or any agreements between Forró Den Haag and the Student shall be resolved by the competent court in The Hague, Netherlands.
